1. General
1.1. «Mareqs» Site provides services under the terms specified in this User Agreement (hereinafter - the "Agreement"). For User the Agreement date is the beginning of use of Mareqs. For Customer the Agreement date is a registration at Mareqs. When the User / Customer starts using the Site / passes registration, he is considered to accept the Agreement in full, without any reservations and exceptions. In case of disagreement with any provision of the Agreement, the User / Customer has no right to use the Site.
1.2. Usage of Mareqs is governed by this Agreement, the Privacy Policy, the Rules of posting information on the Site. The Agreement may be amended by Mareqs without any prior notice, the new version of the Agreement shall enter into` force upon its posting on the Internet (at https://mareqs.com/user-agreement), unless otherwise provided in the new version of the Agreement.
1.3. Mareqs is focused on a wide range of companies and individuals involved in search (Users), as well as on companies and individuals interested in dissemination of information (Customers) about the Equipment, materials and services for construction, maintenance, repair and modernization of various types of ships, floating structures and drilling platforms. Log in to become the Customer.
2. Definitions
2.1. Site (Mareqs) includes mareqs.ru or mareqs.com websites and all related services.
2.2. Customer is a Company and an individual interested in dissemination of information about the Equipment, materials and services for construction, maintenance, repair and modernization of various types of vessels, floating structures and drilling platforms and who has joined the Site.
2.3. User is a Company and an individual engaged in the search for Equipment, materials or services on the Site.
2.4. Requisites are data necessary to constitute the Contract with the Customer.
2.5. Profile is a section of the Site through which the Customer can publish information on services and products, get information support of the Site Administration, add a tender, and conclude a contract.
2.6. Company is an entity that can be created by a Customer with an appropriate description for promotion and advertising of a real Company.
2.7. Equipment / services are an entity that can be created by a Customer with an appropriate description for promotion and advertising of Equipment supplied by a real Company.
2.8. Tender is an entity that can be created by a Customer with an appropriate description for search of a supplier of Equipment or services.
2.9. Content is information about Equipment, materials, services, tenders posted in Profile section of the Site by the Customer.
2.10. Rate is a list of options provided by the Site for presentation of products by the Customer (The Rate is chosen by the Customer during registration).
2.11. Information Block is data on separate Equipment, service or tender advertised by the Customer on the Site, or description of a Company. The information block is the minimum amount of data that can be forwarded for translation. The Site generates the Information block basing on the data loaded in Profile section of the Site by the Customer.
2.12. Category is a general name of the list of Equipment, materials or services, grouped by function or associated by the applicability or related to a certain shipbuilding industry. The list of categories is organized in a hierarchical order.
2.12.1. Top-level Category is the most generalized group of Equipment, materials or services. It includes intermediate categories.
2.12.2. Root Category is narrowly specialized group of Equipment, materials or services. The Customer can add his Content just into the Root categories.
2.12.3. Intermediate categories serve to move from Top-level categories to the Root categories.
2.13. Additional documentation is technical specifications, installation and adjustment procedure, pictures and other documentation related to the advertised product in the format of pdf, dxf, dwg, tiff, jpeg, etc. that the Customer can store on the Site to familiarize Users with his products.
3. Description of Services
3.1. The Customer gains access on Mareqs to Profile section, where he can publish information about his Company, contact information, Company description; information on services, including technical specifications and goods and services description necessary for evaluation of the advertised product, the Customer also gains ability to add tenders and attract other suppliers of Equipment and services. The Customer can also post Additional documentation on the Site in amount and in number, specified by the chosen Rate.
3.2. Mareqs provides translation of information (added by the Customer in Profile section of the Site) into Russian / English on its own. The Customer can provide his translation to be published on the Site. To do this, contact the support service. Translation is executed only for information displayed on the Site. Translation of documents placed in the form of links to Documents on the Site of the Customer or Additional documentation posted on the Site can be performed as per the separate contract.
3.3. The User gains access on Mareqs to the information posted by the Customers, including tools for search and communication with the Customers.
3.4. Individuals or organizations can order translation into Russian / English in accordance with a separate contract. The terms of the service are placed on “Translation of Documentation” page.
4. Customer’s Registration
4.1. To be able to publish information about products and services offered by the Company, the Customer must join, after that the customer gets access to Profile section of the Site.
4.2. When joining the Customer chooses a login (unique symbolic name for the account of the Customer), the password for access to the Profile, e-mail address, language of his Content and the Rate. Responsibility for safety (resistance to guessing) of the chosen password is assigned to the Customer.
4.3. Customer’s Personal Information contained in the Customer's account is stored and processed by Mareqs under the terms of the Privacy Policy.
4.4. The Customer has the right to apply for removal of his Profile on Mareqs, for that please contact Mareqs support service.
4.5. After joining the Customer can fill his section with the Content.
5. Customer’s Content
5.1. The Customer on his own adds information about the Company, Equipment, materials, services and tenders in the Profile section of the Site.
5.2. Descriptions of Equipment, materials, companies, tenders and services are tied to the appropriate Categories. The number of available categories, into which the Customer can add Information blocks, is determined by the characteristics of the selected Rate. The names of the Categories describe the main list of Equipment, materials and services used in shipbuilding. In case of justified need and in consultation with the Administration of the Site new categories may be added. To do this, the Customer shall contact the support service by following e-mail (support@mareqs.com) or use instant messaging - "Tickets".
5.3. The Site Administration reserves the right to change the hierarchical structure of Categories. If necessary, the Category level change from Root level to Intermediate level, Administration of the Site will transfer the Content to the Customer into one of the new Root Categories without notification of the Customer.
5.4. The Customer undertakes to:
5.4.1. Provide accurate and complete information about the Company, Equipment, materials, services, and monitor the relevance of this data. If the Customer provides incorrect data, or if Mareqs has reasons to believe that the data provided by the Customer is invalid, the Mareqs has the right to apply to the Customer for confirmation of the provided data, otherwise to lock the Profile, thereby making information on products and services offered by the Company inaccessible to Users.
5.4.2. The Customer undertakes to add his Information blocks into the relevant Categories tied up by appointment, applicability or relating to the certain shipbuilding industry, described by the selected Category. If the Customer adds his Information blocks in the categories not logically related to the advertised product, the Mareqs has the right to apply to the Customer to change the referencing of the Information blocks. Otherwise, the Mareqs shall lock these blocks, thus making them inaccessible to Users.
5.5. The Customer adds Information blocks in the Profile section of the Site. On completion of the Information blocks publication the Customer notifies Mareqs using the interface of the Site in the Profile section.
5.6. Mareqs translates information added by the Customer into Profile section of the Site into Russian / English language and opens public access to the Information block of the Customer on the Site. Translation is performed by professional translators of Mareqs. Translate is performed for information displayed on the Site only. Translation of documents placed in the form of links to documents on the Site of the Customer, or Additional documentation available on the Site, may be performed under a separate contract.
5.7. The Customer may add Information blocks during the entire period of the contract, in an amount prescribed by the Rate characteristic; these Information blocks are available on the Site within the contract effect.
5.8. When translation is published, the translated Content of Information blocks in the Profile section of the Site can be corrected under a separate Agreement with the administration of the Site. Untranslatable Content of Information blocks in the Profile section of the Site can be changed by the Customer within the contract effect. Untranslatable Content includes photographs, diagrams, drawings, contact persons’ telephones, and other information that does not require translation.
6. Cost of Services
6.1. Registration and creation of an account on the Site, access to the Profile section of the Site, publishing of contact information of the Company; information on products and services, additional paid services are performed in accordance with the Rates.
6.2. Terms of additional paid services are available on “Translation of documentation” page on Mareqs.
7. Restrictions on the Content
7.1. Information on Mareqs shall be published in full compliance with the Rules of posting information on the site.
7.2. Mareqs administration does not carry compulsory verification of information posted by the Customer.
7.3. Mareqs administration is not responsible for errors, inaccuracies, omissions, which were made during registration, translation or posting of information as well as any material or immaterial damages arising in connection with this.
7.4. Mareqs administration is not responsible for the use (both lawful and unlawful) of information posted on Mareqs by third parties, including reproduction and distribution, carried out in the framework of Mareqs, or any other means possible.
7.5. All information posted on the Site is considered to be a property of the Customers who has placed it. Mareqs Users do not receive any rights to use the information posted by the Customer and are fully responsible to the owners for information illegal use.
8. Limitation of Liability
8.1. Information posted on Mareqs Site, is advertising - informational only and is intended to illustrate the possibilities of the Customer in the supply of Equipment, materials and services for construction, maintenance, repair and modernization of various types of vessels, floating structures and drilling platforms.
8.2. The Customer is solely responsible for the posted Content.
8.3. The Customer is solely responsible for the compliance of the Content posted by the Customer with the requirements of current legislation of the Russian Federation; he also bears third-party liability in cases when the Content or its posting by the Customer violates the rights and legitimate interests of third parties, including moral rights of authors, other intellectual property rights of third parties and / or infringes intangible benefits belonging to them.
8.4. If it is not directly stated in the text legislation of what country should be considered, it should mean the legislation of the Russian Federation (RF).
8.5. Services on Mareqs are provided "as is". Mareqs administration does not guarantee the safety of Customer’s Profile, Customer’s Site and information posted on Mareqs.
8.6. Mareqs administration guarantees to the Customers periodical saving (backup) of information posted on the Site. Mareqs administration makes every effort to save the information posted by the Customer, but does not ensures its safety in the event of force majeure (such as damage to the provider's server, fires, floods, earthquakes, and so on).
8.7. Mareqs administration does not check the posted information and it is not responsible for the information compliance with legislation of the Russian Federation.
8.8. You totally understand and accept that:
8.8.1. Mareqs administration does not guarantee the absence of errors and failures, including those related to the software. Mareqs administration makes every effort to eliminate any faults and errors, if they occur, as soon as possible.
8.8.2. Mareqs administration does not guarantee that the services will meet your requirements, will be provided continuously or error free.
8.8.3. Download of any information or materials from Mareqs Site is performed at your own risk. You are fully responsible for any loss of data or damage caused to your computer by downloading information from Mareqs Site.
8.9. Mareqs administration reserves the right to delete information posted by the Customers of pay packages or to block access to them without warning, in the case when:
8.9.1. We receive binding decisions of regulatory authorities of Russia (the Russian Federation).
8.9.2. We receive requirements of the owner of copyright or neighboring rights to cease violations of his rights by the User of Mareqs Site.
8.9.3. We receive substantiated appeal from other users of Mareqs Site, legal entities and individuals proving violations of their rights or legitimate interests.
8.9.4. We detect information, which is prohibited for placement on the Site in accordance with this Agreement and the Rules of posting information on the Site.
9. Exclusive Rights to the Content of the Site
9.1. All objects available by means of Mareqs, including design elements, text, graphics, images and other objects, as well as any Content posted on the Site are subject to the exclusive rights of Mareqs, Customers and other rights holders.
9.2. Use of the Content is only possible within the framework of Mareqs functionality. Any Content posted on Mareqs, cannot be used otherwise without the prior permission of the copyright holder. Using means, including the following: reproduction, copying, processing, distribution on any basis, display in a frame, etc. Exceptions are cases directly provided by the legislation of the Russian Federation.
10. Sites and Content of Customers, Third Parties
10.1. The Site contains links to other Sites on the Internet (Sites of Customers, third parties). These Customers and third parties and their Content are not checked by Mareqs for compliance with requirements (accuracy, completeness, legality, etc.). Mareqs is not responsible for any information, materials posted on the Sites of third parties to which a User or a Customer gets access through the use of the Site.
11. Newsletters
11.1. The Site may implement sending messages to the e-mail specified by the Customer during registration. Usually the Site uses this possibility in the cases noted below.
11.1.1. Transfer of the user's query on your Equipment formed by using the Site interface.
11.1.2. News mailing produced if it is necessary to inform the Customer on the new options of the Site, to send reports or other important information.
11.1.3. Automatic notification on interaction of the Customer with the Site interface: notification on translation readiness, locking of Profile and so on.
11.1.4. When sending the formed contract, report on payment receipt, when it is required to inform the Customer about approaching the end of the paid period and etc.
11.1.5. When the Customer interacts with his Profile: confirmation of registration and password recovery.
11.2. The Customer may withdraw from mailing and newsletters, (paragraphs 11.1.2, 11.1.3) using the Site interface, in Profile section.
12. Support Service
12.1. If any questions related to the use of the Site appear, the User / Customer may contact the Support Service by the following e-mail: support@mareqs.com. "Tickets" instant messaging is available for the Customers. Tickets service is available in Profile section of the Site.
